How It Works
Possession Orders Explained
Before enforcing a possession order, it is important to understand what it is, how it is obtained, and how long it remains valid. Knowing these key details helps you navigate the process with confidence and ensures any enforcement action is carried out correctly and efficiently.
What is a Possession Order?
A Possession Order is usually issued by the County Court to require a tenant to vacate a property by a set date. It is the legal foundation for any eviction and must be obtained before contacting Equivo to enforce possession.
How to Obtain a Possession Order
Applications can be made using Form N5 through the County Court or via the government’s online service if the repossession is due to unpaid rent or mortgage arrears. The tenant receives notice and has the opportunity to appeal.
Duration of a Possession Order
A Possession Order remains enforceable for up to six years from the date it is granted. Delays in enforcement may affect the Court’s willingness to grant further orders.

How Equivo Enforces a Possession Order
1.
Transfer to High Court
If the tenant does not leave the property by the date set in the County Court Possession Order, the case can be transferred to the High Court. This allows a Writ of Possession to be issued, providing the legal authority needed to regain control of the property efficiently and securely.
2.
Dedicated Support
Every client is provided with a dedicated point of contact who guides them through the High Court application process. This includes assistance with completing the necessary forms and answering any questions, ensuring the transfer and enforcement process is handled quickly and correctly.
3.
Enforcement by HCEOs
High Court Enforcement Officers attend the property to manage access and ensure tenants leave in accordance with the law. Officers conduct each visit professionally and safely, recording actions as necessary, and ensuring that all steps comply fully with legal and regulatory requirements.
4.
Property Security Advice
