Commercial Rent Arrears Recovery (CRAR) is the statutory process established under the Tribunals, Courts and Enforcement Act 2007 that enables commercial landlords to recover commercial rent by taking control of a tenant’s goods and, if necessary, arranging removal and sale. It applies only to commercial premises under a written lease and can include VAT and interest where specified.

The CRAR Process

We issue a Notice of Enforcement giving the tenant 7 clear days to pay outstanding rent and associated charges.

Taking Control of Goods
If payment is not made, our agents attend the premises, seek payment in full, and may enter into a Controlled Goods Agreement to secure the debt.

Removal and Sale of Goods
If payment is not forthcoming, and with landlord consent, we arrange removal and sale of goods at public auction. Proceeds are applied against the arrears and costs.

What can be recovered under CRAR?
CRAR applies to principal rent, VAT, and interest (where specified in the lease). Service charges, insurance, and rates cannot be recovered under the process.
When can CRAR be used?
CRAR can be used where there is a written commercial lease in place. It cannot be applied to residential or mixed-use premises. Enforcement may be carried out between 6am–9pm, or during the tenant’s normal business hours.
What goods can be seized?
Only goods owned by the tenant can be seized. Goods belonging to third parties or sub-tenants are excluded. Tools of the trade up to a value of £1,350 are exempt.
How much does CRAR cost the landlord?
A fee of £75+VAT is payable but refunded upon successful recovery, as costs are charged to the tenant in accordance with the Taking Control of Goods (Fees) Regulations 2014.
What happens if the tenant has left the property?
Where tenants have vacated, Equivo can still support landlords through enforcement of judgments linked to the tenancy, demanding payment or seizing goods at new premises.
What’s the difference between commercial lease forfeiture and CRAR?
